Terms of Service

These Terms are a legal agreement between you and Pinehurst Investment Group Limited (company no. 16073869), a company registered in England & Wales and trading as "Groundwork" ("Groundwork", "we", "us"), for your use of the Groundwork service (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. What Groundwork is
Groundwork is a self-serve tool that helps a small business owner scope a software problem and produce a pack of planning documents. It guides you through stages, asks questions, and — as part of the paid journey — gives you an impartial shortlist of software options and setup guidance. 1a. Groundwork is in beta
The Service is in open beta. That is not a marketing label — it changes what you should expect and what you are agreeing to:
- It is unproven. Groundwork has not been used at scale. Features may be incomplete, and parts of it will change or be removed.
- Its answers can be wrong. The Service uses AI models. Outputs are a starting point to check, never a decision to act on unchecked. Do not spend money on the strength of a Groundwork recommendation without verifying it yourself. See the Recommendations Disclaimer.
- Availability is not guaranteed. There may be downtime, and we may pause or withdraw the beta.
- Your data may be affected by beta changes. We take reasonable care of it (see the Privacy Policy), but during beta we may need to migrate or reset data as the product changes. Keep your own copy of anything you would be sorry to lose.
- We read beta sessions. Understanding where the Service gets things wrong is the point of a beta. What we look at, and how it is protected, is set out in the Privacy Policy.
Beta status does not reduce your statutory rights, and it does not limit our liability for anything the law says cannot be limited — see section 10.
2. Who can use it
You must be 18 or over and using the Service for a business or trade. By using it you confirm you have authority to accept these Terms on behalf of that business.
3. Your account
You sign in with a magic link sent to your email. You're responsible for keeping access to your email secure and for activity under your account. Tell us promptly at support@pinehurstproperty.co.uk if you think your account has been misused.
4. Plans, pricing and payment
- Stage 1 is free. It scopes your problem and produces your Project Brief at no charge.
- The full journey is a one-off £299 per project. Paying unlocks the later stages, the software shortlist, and the full document pack for that project. It is a single payment, not a subscription: nothing renews and no further charges are made. Current pricing and what's included are shown on our /pricing page and may change from time to time.
- We take payment through Stripe. When you pay, you ask us to start supplying the digital documents to you immediately.
- Prices are in GBP and, unless stated, exclusive of any applicable VAT.
5. Cancellation and refunds
- Who these rights belong to. "Consumer" means an individual buying wholly or mainly outside their trade, business, craft or profession (Consumer Rights Act 2015, s.2(3)). If you buy for your business, the consumer cancellation rights below don't apply, but the "if something's wrong" promises do.
- Your 14-day right to cancel. Where you buy as a consumer, you have 14 days to cancel, starting on the day the contract is made — the day you pay (Consumer Contracts Regulations 2013, reg 30(2)).
- Why you're asked to give it up at checkout. The paid documents are digital content, delivered immediately. Before you pay, we ask for two things with an unticked checkbox: your express request that we begin supplying immediately, and your acknowledgment that once we've begun, you lose the right to cancel (reg 37(1)). We restate both in your order confirmation email. If we ever failed to collect that consent or send that confirmation, your cancellation right would survive delivery — that is the law (reg 37(3)-(4)), and we've built the checkout so it cannot happen.
- If you cancel in time (for example, you paid without ticking the box — which our checkout prevents — or before delivery began), we refund in full within 14 days of you telling us, to your original payment method, with no fee (reg 34).
- If something's wrong on our side — the documents fail to generate, are faulty, or don't match what we described — we re-run, fix, or refund. Faulty digital content refunds are made within 14 days of us agreeing you're entitled (Consumer Rights Act 2015, s.45). Your statutory rights are unaffected.
- Stage 1 is free precisely so you can judge the standard of the work before paying anything. Full detail is in our Refund Policy.
5a. Business customers
- Where you buy for your trade or business, we supply the Service with reasonable care and skill (Supply of Goods and Services Act 1982, s.13).
- Our total liability to business customers is capped at the amount you paid for the project in question, except that nothing limits our liability for death or personal injury caused by negligence, or for fraud.
6. Your content and our intellectual property
- You own your answers and the documents Groundwork generates for you. You grant us a licence to process them to run the Service (including via the AI providers described in our Privacy Policy) and to build an internal profile of your business as described there.
- We own the Service itself — the platform, software, knowledge base, scoring method, catalogue and branding. You may use your documents freely for your own business; you may not resell or redistribute the Service or our underlying content.
7. Acceptable use
You agree not to misuse the Service. See our Acceptable Use Policy. We may suspend or close accounts that break it.
8. Impartiality and third-party software
Our software recommendations are impartial: we take no commission, affiliate fee or payment from any vendor to be listed or ranked. We don't control third-party software and aren't responsible for it — its pricing, availability, performance, terms or how it handles your data are between you and that vendor. Always confirm current pricing and suitability with the vendor before you buy. See the Recommendations Disclaimer.
9. Availability
We work to keep the Service available but don't guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw features, and carry out maintenance, and we may use AI models whose outputs can contain mistakes — treat the output as a well-informed starting point to check, not gospel.
10. Disclaimers and limitation of liability
- The Service and its outputs are provided "as is". To the fullest extent permitted by law, we exclude implied warranties. Groundwork's guidance is not professional, financial, legal, tax or investment advice.
- Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud).
- Subject to that, our total liability to you arising out of the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period, or (b) £100. We are not liable for indirect or consequential loss, loss of profit, or losses from your decision to buy, not buy, or use any third-party software.
- If you use the Service as a consumer rather than for a business, your statutory rights are not affected.
11. Indemnity
If you use the Service in breach of these Terms and that causes us loss or a third-party claim, you agree to cover the reasonable costs, to the extent the loss is caused by your breach.
12. Termination
You can stop using the Service any time. We may suspend or end your access if you break these Terms or the Acceptable Use Policy, or where we must for legal or security reasons. On termination, the sections that by their nature should survive (e.g. IP, liability, governing law) continue.
13. Governing law
These Terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts.
14. Changes to these Terms
We may update these Terms. We'll change the "last updated" date and, for material changes, give reasonable notice. Continuing to use the Service after changes means you accept them.
